Terms and Conditions Speedminton 

1. When do these Terms and Conditions apply?

These Terms and Conditions (hereinafter "T&Cs") apply to all offers and agreements related to the sale and delivery of products by Speedminton GmbH, entered into by a consumer or business regarding the goods displayed in the online shop. By ordering from our website (www.speedminton-shop.com) or accepting an offer from Speedminton GmbH, you confirm your acceptance of the applicability of these T&Cs during the order process. Any deviations from these T&Cs require written approval from Speedminton GmbH.

A consumer within the meaning of these T&Cs is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity. A business is a natural or legal person or a partnership with legal capacity acting in the course of its commercial or self-employed professional activity when entering into a legal transaction.

2. How is a contract formed with us?

The product descriptions in the online shop do not constitute binding offers but serve as invitations to submit a binding offer by the customer.

The customer may submit an offer via the online order form integrated into the seller's online shop. By placing the selected items in the virtual shopping cart, completing the electronic ordering process, and clicking the final button, the customer submits a legally binding contractual offer regarding the items in the cart. Alternatively, offers may be submitted by phone, fax, email, post, or online contact form.

The purchase contract is only concluded when the seller:

  • Sends a written order confirmation (via email or fax), or

  • Delivers the ordered goods to the customer (receipt is decisive), or

  • Requests payment from the customer after placing the order.

If several of these alternatives apply, the contract is concluded with the first action taken.

You guarantee that the information you provide to Speedminton GmbH in the inquiry or order is correct and complete. Speedminton GmbH is not obligated to accept an order and may review or reject it without stating reasons. If Speedminton GmbH does not confirm your order within 7 business days, the order is deemed rejected. The period for acceptance starts the day after the order is submitted. If the seller does not accept the offer within this period, the customer is no longer bound by their declaration of intent.

Order processing and communication usually occur via email and automated processes. The customer must ensure the provided email address is accurate so that emails from the seller can be received. In particular, customers must ensure that spam filters do not block emails from the seller or third parties involved in order processing.

3. Right of Withdrawal

Consumers generally have a statutory right of withdrawal. Detailed information is provided in the seller's cancellation policy.

4. Prices and Payment Conditions

The offers on our website are non-binding and do not obligate Speedminton GmbH in any way. Minor color or product deviations may occur due to various image or display technologies. Speedminton GmbH is not liable for such deviations.

Unless stated otherwise, all prices in the webshop are total prices including statutory VAT and are shown in Euros. Shipping costs are detailed under "Shipping and Delivery."

Available payment methods are listed in the webshop.

If prepayment by bank transfer is agreed upon, payment is due immediately unless a later due date has been agreed.

5. Delivery

Goods are delivered to the shipping address provided by the customer unless otherwise agreed. The delivery address specified during checkout is decisive.

If the shipping company returns the goods due to a failed delivery attempt, the customer bears the cost of the unsuccessful delivery unless the customer is not responsible for the failure or was temporarily unable to accept the delivery. This does not apply to shipping costs if the customer exercises their right of withdrawal. Return costs in this case are governed by the seller's cancellation policy.

Self-collection is not possible for logistical reasons.

Deliveries take place on business days that are not holidays. A signature may be required upon delivery.

6. Retention of Title

The delivered products remain the property of Speedminton GmbH until full payment is received.

7. Warranty (Liability for Defects)

Statutory warranty provisions apply in the case of defective goods. Customers are encouraged to report any obvious transport damage to the delivery service and inform the seller. Failure to do so does not affect the customer’s legal or contractual warranty rights.

8. Applicable Law

The purchase contract is governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

9. Trademarks and Product Use

Use of Speedminton GmbH trademarks for advertising purposes is only permitted with prior written consent. Promotional materials provided by us may only be used for the intended purpose of promoting and selling SPEEDMINTON products.
